Processing Times for EB-5 Petitions Soar
IIUSA, the national trade association for the EB-5 Regional Center Program, released a new report on May 30, 2017, highlighting the delayed processing times for I-526, Immigrant Petition by Alien Entrepreneur, and I-829, Entrepreneur to Remove Conditions on Permanent Resident Status, petitions.
Sadly, processing times for I-526 and I-829 petitions are at a record high, 18.6 and 30 months respectively.
Currently the United States Citizen and Immigration Services (USCIS), is processing I-526 cases from September 20, 2015; and I-829 cases from October 12, 2014.
According to IIUSA, in a year-over-year comparison, adjudication of I-829 petitions are taking approximately one year longer to be determined to date; while I-526 petitions are slightly more than 2 months further delayed. Please see IIUSA’s graph below, displaying the year-over-year comparisons.
No one knows for sure why the increased slow-down at the Investor Program Office of USCIS. Speculation about why the delays have increased vary; but clearly the increase in recent filings due to the present uncertainty regarding the program’s future, is one of the root causes. Many investors are correctly determining it will be more advantageous to invest now, rather than wait for the certain significant increases that will result regardless of whether Congress acts, or USCIS’ regulation become final; either of which will come before the end of September 2017.
